The term used by A.B.L "Free Quotes, Estimates Designing and Site Visits" is now subject to Terms and Conditions. Condition # 1 being that if the Director (Mathew Den Boogert) or A.B.L at the initial contact time between A.B.L and the client/potential client questioning stage or at any other stage is satisfied or unsatisfied with the answers given by the client/potential client relating to their project/proposed project. For example: The Director may ask the client/potential client "Are you getting any other quotes for your project? If so, how many?" or "Please describe to me exactly what your project involves as it may require council consent/resource consent etc prior to any Quotation, Estimate, Designing and Site Visit/Building works etc taking place" or "What is your budget for the proposed project and when would you like to start your project?" or "Will you the client/potential client be onsite and be able to access ALL the areas onsite to be Quoted, Estimated, Designed and Site Visited at the time agreed to by A.B.L and the client/potential client?" Condition # 2 The client/potential client is not to withhold any important/relevant information about their project that if disclosed to A.B.L could affect the client/potential clients chances of obtaining a Free Quote, Estimate, Designing and Site Visit by A.B.L. for their project. Depending on the clients response to either or all of these questions above the Director/A.B.L may decide to solely at our discretion: Option (A) Give a Free Quote, Estimate, Designing and Site Visit to the client/potential client relating to their project. Option (B) Not to give a Free Quote, Estimate, Designing and Site Visit to the client/potential client relating to their project. Option (C) Advise the client/potential client there will be a charge to give a Quote, Estimate, Designing and Site Visit relating to their project. The applicable option (A,B or C) and the amount of the charge for the quote (if applicable) will be advised to the client/potential client by the Director/A.B.L at or just after the time of the initial contact between A.B.L and the client/potential client BUT prior to any Quotation, Estimate, Designing and Site Visits are carried out by A.B.L so that the client/potential client may choose to continue with A.B.L's services or not to continue with A.B.L's services before any charges apply to the client/potential client. Should the client at any stage fail to disclose to the Director/A.B.L his/her actual budget for their project or be untruthful in any way with A.B.L particularly if the client has or intends to acquire more (Outside of A.B.L's Quotation Etc) Quotations, Estimations Designing and Site Visits relating to their project "Clause 1" (Outlined below) may apply to the client/potential client. At the initial contact stage or at any other stage should the client wish to engage A.B.L's services the listed Terms and Conditions (A.B.L's questions) apply and a legally binding verbal and/or written contract between both parties exists and is knowingly entered into by both parties (A.B.L's Terms and Conditions are explained to the client/potential client during the initial contact stage by A.B.L and/or are listed and avaliable at www.aucklandbuilders.info). In the event of the client/potential client being untruthful with or withholding relevant information regarding the proposed project from the Director/A.B.L at the initial questioning stage or at any other stage which subsequently leads to: A Quotation, Estimate, Designing and Site Visit or any of these individually or combined being given by A.B.L to the client/potential client "Clause 1" may be used (At A.B.L's discretion) and is outlined as follows and may apply to the client/potential client: Clause # 1: "The client/potential client has been untruthful/withheld relevant information about their project from/with A.B.L and in answering the questions asked by A.B.L at the initial contact stage or at any other stage which are the Terms and Conditions of A.B.L's "Free Quotes, Estimates, Designing and Site Visits" policy. Clause 1 continued.. The Free Quote, Estimate, Designing and Site Visit is now chargeable to the client/potential client for "Miss-using and/or wasting A.B.L's business hours". Using reasonable, fair and current market charge up Directors rates of $55.00 + GST per hour, the client/potential client must reimburse A.B.L for lost business time. The charge to the client/potential client is payable in full to A.B.L within 7 days and may be invoiced by either mail or email to the client by A.B.L. In the event the invoiced charge is unpaid after 7 days a Debt Collection agency may be engaged by A.B.L without further notice/warning to the client/potential client to collect unpaid invoiced charges on behalf of A.B.L. The Debt Collector may in turn add additional collection fees on top of the original invoiced charge by A.B.L. A.B.L will not be held responsible for any legal action or collection method(s) used by the nominated Debt Collection Agency against the client/potential client to collect unpaid invoices. The nominated Debt Collection Agency is deemed a necessary form of legal collection of funds owed to A.B.L by the client/potential. The charge to the client/potential client by A.B.L of $55.00 + GST per hour for lost business time is necessary to cover costs incurred to A.B.L caused by the untruthful client/potential client which otherwise may have been avoided had the client/potential client been truthful with and/or not withheld relevant information from the Director/A.B.L regarding their proposed project at the initial contact stage or at any other stage prior to Quotation, Estimation, Designing and Site visit by the Director/A.B.L.
